Introduction to Public Law is a historical and comparative introduction to public law. The book traces back the origins of the res publica to Roman law and analyzes the course of its development, first during the monarchical age in continental Europe and England, and then during the republican age that began at the end of the eighteenth century with the democratic revolutions in the United States and France. For each period and country, the book analyzes the major concepts of public law and their transformations: sovereignty, the state, the statute, the separation of powers, the public interest, and administrative justice.

La notion de libéralisme crée un sentiment trompeur de familiarité : sa présence envahissante dans le débat public brouille le plus souvent sa compréhension. Mais le terme, inventé dans un contexte de luttes politiques, a toujours été chargé d’ambiguïtés. Aussi les recherches réunies ici visent-elles, non à le réduire à une définition dogmatique, mais à en explorer la complexité et les tensions internes. Pour ce faire, elles adoptent un biais particulièrement éclairant : la façon dont la tradition libérale s’est définie en se confrontant aux exigences de la normativité juridique. Les auteurs, spécialistes de philosophie moderne et contemporaine, montrent que le libéralisme ne se réduit pas à une opposition globale à l’idée de norme au nom du « laisser-faire, laisser-passer ». À travers l’étude de moments particulièrement significatifs de son histoire - Locke, Hume, Montesquieu, Bentham, la critique contre-révolutionnaire du libéralisme, Constant, Tocqueville, les anarcho-capitalistes contemporains -, ils donnent plutôt à voir un certain nombre de déplacements dans l’ordre de la normativité. Ils éclairent les débats et les argument suscités par une réflexion renouvelée sur le statut de l’individu, sur le fondement du droit de propriété ou sur la fonction du pouvoir. Legal transplantation and reform in the name of globalisation is central to the transformation of Asian legal systems. The contributions to Examining Practice, Interrogating Theory: Comparative Legal Studies in Asia analyse particular legal changes in China, Indonesia, Malaysia, Singapore, Thailand, Taiwan, and Vietnam. The contributions also concurrently critically analyse the utility of scholarly developments in comparative legal studies, particularly discourse analysis; regulatory theory; legal pluralism; and socio-legal approaches, in the study of Asian legal systems. While these approaches are regularly invoked in the study of transforming European legal systems, the debate of their relevance and explanatory capacity beyond the European context is recent. This is the first of a series of national reports on basic issues concerning the acquisition and loss of ownership of movable assets. The series is planned to cover 27 European legal systems, distributed over six volumes, as a product of the research activities of the working group "Transfer of Movables" within the "Study Group on a European Civil Code". Starting with general property law issues like the concepts of ownership and possession employed in the respective legal systems, and the related means of protection, the reports primarily deal with the "derivative" transfer of ownership, but extend to good faith acquisition from a non-owner, acquisitive prescription, processing and commingling, and further related issues. The reports provide the reader with detailed information about the respective rules, case law and legal literature, prepared by national property law experts. These reports are a starting point for further comparative research in property law and also a tool for practitioners searching for information on foreign legal systems. Where available and as far as reasonable, the reports include translations of the most important statutory provisions either in the text or in an annex. All reports include a table of literature and a table of abbreviations, which shall facilitate carrying out further research.

There has recently been a remarkable growth in standard-setting with respect to the protection of minorities in international and European law. Layered on top of existing human rights standards relevant to minorities, these developments have resulted in a complex and multi-faceted regime, but one which still does not amount to an integrated and coherent system of minority protection. In addition to providing an up-to-date account of the relevant standards and their development in practice, this collection breaks new ground by seeking to identify the extent to which some integration and coherence (synergy) is emerging as a result of the work of treaty-monitoring bodies and other international institutions. Leading experts on the main instruments and institutions assess matters such as the application of similar principles, the emergence of common themes, explicit cross-referencing between treaty bodies and international institutions and the development of similar working methods.

Insufficient access to a basic water supply is not an unavoidable consequence of water scarcity. In fact, arid countries possess enough resources to fulfil the basic water needs of their populations and there are people in water rich countries suffering from water stress, too. Thus, insufficient freshwater access mainly can be seen as a problem of allocation and mismanagement. This book comprehensively analyses the appropriateness of a human rights-based approach in safeguarding basic water supplies and determines its legal basis in international law. Arriving at the conclusion that international water law does not adequately consider individual water needs, the study identifies applicable human rights and examines the concrete standard of protection they provide. In view of the deficits of current international water and human rights law, the study discusses concepts deemed to strengthen a human rights-based approach to freshwater access by considering both their formal legal appropriateness as well as their suitability in legal reality.

The UN has adopted a "responsibility to protect" mandate for humanitarian intervention in civil wars - but there is no institutional basis for carrying out that mandate. Patricia Marchak argues that unless would-be interveners have an understanding of local issues, agents who speak local languages, and a military force fully prepared to undertake both peaceful and military missions on short notice, UN and other attempts to intervene are unlikely to succeed. While UN-sponsored international criminal courts have been successful in obliging leaders to accept responsibility for their actions during bitter internal wars, Marchak argues that they may not be the best means of bringing truth and reconciliation to survivors. Based on the principle of individual responsibility, they are not designed to deal with collective crimes against humanity and genocide, nor are they good instruments for dealing with the breakdown of societies. Bringing together her own field interviews, documentary material, and secondary sources, Marchak critically assesses the recent history of international interventions and criminal prosecutions. She examines three cases in detail: Cambodia, Rwanda, and the former Yugoslavia in its current forms of Bosnia and Serbia, considers their international context prior to and during internal wars, and argues that each case has to be understood in its own context and history - there is no common pattern and no easy fix that could mend broken societies after the wars. No Easy Fix is of interest to anyone concerned with how the international community deals with civil wars that involve serious crimes against humanity.
